Seabron v. AFSCME, District Council 37

CASE SUMMARY

The Fairness Center represents Edward Seabron, a traffic enforcement agent for the NYPD who resigned from his union, AFSCME, District Council 37, in May 2021. However, his resignation went ignored—while a union official repeatedly harassed him on social media. The union official’s post included a threatening video rant and a photoshopped picture depicting Mr. Seabron shaking hands with someone dressed as a Ku Klux Klan member. Meanwhile, union officials never recognized Mr. Seabron’s resignation, although after several months, the City of New York finally stopped taking union dues from his paycheck. Mr. Seabron brings this lawsuit to vindicate his constitutional rights not to be forced to be associated with or to financially support a union. Separately, Mr. Seabron has also filed a labor board charge to hold the union accountable for allowing the harassing behavior by a union official, who remains in union leadership.
