CASE SUMMARY
The Fairness Center represents Penny Gustafson, a residential services aide at Ebensburg Center, whose alleges that her grievance was mishandled by her union because she is not a member. Ms. Gustafson claims that her union breached its duty to her by failing to provide assistance to her during a workplace investigation, by failing to fairly represent her during a grievance, and by keeping her in the dark about how her grievance was being handled. Ms. Gustafson believes the union treated her this way because she is not a member of the union, as union officials called her a “freeloader” who is “sponging” off the union and told her that she would receive “minimal representation.”
