Smith v. AFSCME 

CASE SUMMARY

The Fairness Center represents Daphne Smith, whose union ignored that she had resigned for nearly two years while it kept taking her dues. Ms. Smith is a Corrections Officer for Albany County, who resigned from her union in April 2019. But union officials never acknowledged her resignation and didn’t stop taking dues from her paychecks until January 2021. And they kept her money. With the help of the Fairness Center, Ms. Smith has brought this federal lawsuit to enforce her constitutional rights not to be associated with or to financially support a union against her will.
